TERMS & CONDITIONS
1. Scope
These Terms & Conditions apply to the use of this website and to all purchases made on it from Laure Victoria Gaury – Maison de Haute Joaillerie, Geneva, Switzerland (details in our Legal Notice). Delivery conditions are set out in our Shipping & Return Policy.
2. Prices, orders and payment
Prices are shown in Swiss francs (CHF). Before confirming an order, you can check and correct the content of your basket and your details on the checkout page. The contract is concluded when you receive our order confirmation by email. Payment is made online through our payment provider when you order.
For deliveries outside Switzerland, customs duties and import VAT are paid by the client.
3. Personal data
Please refer to our Privacy Policy, which also governs your visit to this site, to understand how Laure Victoria Gaury collects, uses and discloses clients’ personal data.
Laure Victoria Gaury will cooperate with requests from the authorities, or with court orders, only where Swiss law requires it.
4. Intellectual property
In accordance with the Swiss Federal Act on Copyright and Related Rights (LDA) and other applicable laws, Laure Victoria Gaury reserves the right to terminate access for users or account holders who infringe intellectual property rights.
5. Third-party content
Laure Victoria Gaury may provide links to third-party web pages and content (“third-party content”) as a service to individuals interested in such information. Laure Victoria Gaury does not monitor or control third-party content or websites, does not endorse them and cannot guarantee their accuracy or completeness. Users access such links and third-party content at their own risk.
6. Your messages and content
Ideas, comments, suggestions or other materials that you send us about this site or about Laure Victoria Gaury’s products and services are not confidential. Laure Victoria Gaury may use them freely, without compensation.
From time to time, Laure Victoria Gaury may ask social media users for permission to feature their content (for example a photograph of a piece) on its website, social channels or promotional materials. If you agree, you grant Laure Victoria Gaury a free, non-exclusive right to use this content to present its work, with mention of your username if you wish. You may withdraw this permission at any time for future uses by writing to us. Your image or your name will never be used without your explicit consent. You confirm that you hold the rights to the content you share and that it does not infringe the rights of others.
In any area of the website or our social media accounts where users can post content, you agree not to publish any material that is unlawful, defamatory, obscene, harassing, threatening, invasive of privacy, fraudulent, or that infringes the rights of others, nor any unsolicited advertising, private information of a third party (such as addresses, phone numbers or bank details), viruses or harmful files. Laure Victoria Gaury may remove any such content.
7. Responsible sourcing
Laure Victoria Gaury works with independent artisans and suppliers. Laure Victoria Gaury selects suppliers who are bound by recognised standards for responsible jewellery: certification by the Responsible Jewellery Council (RJC), GreenGold or recycled gold, and diamonds sourced in compliance with the Kimberley Process. The RJC Code of Practices includes respect for human rights and the prohibition of forced labour and modern slavery in the supply chain. The certifications concerned are disclosed upon the client’s express request.
GIA, HRD or IGI certificates are provided for all gemstones over 0,9 carats, and can also be provided for smaller stones upon the client’s express request.
If a supplier no longer meets these standards, Laure Victoria Gaury will ask for corrective measures and will end the relationship if necessary.
8. Warranty
All pieces are covered by a two-year warranty against manufacturing defects (defects in workmanship), from the date of delivery. The warranty covers defects in workmanship only. It does not cover normal wear, damage caused by impact, misuse or lack of care, loss or breakage of stones following an impact, nor pieces that have been altered or repaired by a third party. To make a claim, please contact us as soon as you notice the defect.
9. Returns
A change-of-mind return is accepted within ten (10) days of receipt of the piece. This is a voluntary commercial policy and does not constitute a legal right of withdrawal under Swiss law. Clients residing in the European Union also benefit from the 14-day right of withdrawal and the legal guarantee of conformity provided by the law of their country of residence; custom-made or personalised pieces are excluded from the right of withdrawal. The following are excluded from return: custom-made or made-to-order pieces, items resized to specific measurements, and pieces showing signs of wear, alteration or damage. Returned items must be in their original condition, with all packaging and documentation included. The piece must be returned within ten (10) days of its receipt. Once the piece has been received and inspected, and if everything is in order, the refund is initiated within 3 to 5 business days; depending on your bank, it may take a few more days to appear on your account. Details are set out in our Shipping & Return Policy. Custom-made or personalised pieces are excluded from this right.
10. Use of the website
Laure Victoria Gaury takes great care with the operation of this site and the accuracy of its content, but cannot guarantee that the site, its servers or its communications are always available, error-free or free from viruses. You use this site at your own risk.
11. Liability
To the extent permitted by law, Laure Victoria Gaury is not liable for indirect damage arising from the use of this site, such as loss of profit or loss of data. Liability for direct damage is limited to the amount paid for the product or service concerned. These limitations do not apply in cases of intent or gross negligence, nor where mandatory law provides otherwise.
If you breach these Terms & Conditions, you are liable for the damage caused to Laure Victoria Gaury as a result, in accordance with Swiss law.
Laure Victoria Gaury may restrict or terminate access to the site for any user who breaches these Terms & Conditions.
12. General provisions
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions remain in full force and effect. The failure of Laure Victoria Gaury to enforce a provision does not constitute a waiver of that provision.
Laure Victoria Gaury may modify these Terms & Conditions at any time. The version published on the site at the time of your order applies to that order.
13. Applicable law and jurisdiction
These Terms & Conditions, and all purchases made on this site, are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention). The courts of Geneva, Switzerland, have jurisdiction, subject to the mandatory rules that allow consumers to bring an action before the courts of their place of residence.
